Port Facilities Port Facilities

The port Licence and Authorisation legal system is regulated pursuant to Title IV of Law 48/2003 of 26 November concerning the Economic and Service Provision System for Ports of General Interest (Article 92 and ff.):

  • The occupation of port public domain for a period of no longer than three years, including extensions, with furnishings and collapsible installations, or without them, shall be subject to prior authorisation from the Port Authority.
  • The occupation of port public domain, involving works or non-collapsible installations, or uses for a period of over three years, shall be subject to the prior granting of a licence by the Port Authority.

On 5 April, 2008 Order FOM/938/2008 of 27 March was published in the Official Gazette of the Spanish State approving the general conditions for the granting of state port public domain licences:
